What is California Prop 65?

Formerly known as the Safe Drinking Water and Toxic Enforcement Act, Proposition 65 mandates the publication of a list of chemicals that the State of California has determined to cause cancer or birth defects. It also requires companies selling products containing these chemicals to inform California residents about the potential risk of exposure by including a warning notice on the product label or by providing this information to the customer before purchase. Proposition 65 warning notices are prominently displayed throughout California, spanning restaurants, grocery stores, hotels, bars, schools, hospitals, and amusement parks.

Who Must Display a Prop 65 Warning?

Proposition 65 necessitates companies to include this notice on their products if any ingredient exceeds 1/1000th of what the World Health Organization deems as “Safe Harbor Levels” for their list of chemicals, which includes certain naturally occurring minerals. While many regions typically rely on federal regulations for such standards, California has established its own specific laws and requirements that businesses must adhere to if they intend to operate within the state. It’s important to note that Proposition 65 warnings do not imply that the product is unsafe. Rather, they are meant to inform California consumers about the presence of a Proposition 65-listed chemical, allowing consumers to make informed choices when purchasing these products. It’s worth mentioning that heavy metals like lead, arsenic, cadmium, and mercury naturally occur in soil and water. As plants grow, they absorb nutrients from the soil and water, including trace amounts of these naturally occurring heavy metals.
